Same-sex Divorce

In 2005, same-sex marriage became legal in all provinces across Canada. If you have been legally married in Canada, you require a legal separation and divorce in order to remarry.

The Significance of Bill C-32

Prior to Bill C-32, which was introduced in 2012, same-sex couples who got married in Canada, but resided in another country, were unable to get divorced.

After the introduction of Bill C-32, same-sex divorce in Canada is legal as long as the following criteria is met:

  • The marriage took place in Canada
  • The couple’s primary place of residence does not recognize same-sex marriage
  • The couple must be separated for at least 12 months
