The Significance of Bill C-32
Prior to Bill C-32, which was introduced in 2012, same-sex couples who got married in Canada, but resided in another country, were unable to get divorced.
After the introduction of Bill C-32, same-sex divorce in Canada is legal as long as the following criteria is met:
- The marriage took place in Canada
- The couple’s primary place of residence does not recognize same-sex marriage
- The couple must be separated for at least 12 months
